JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 28-05-2019 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State as well as learned counsel appearing on behalf of the informant. The petitioner is in custody in connection with Kotwali P.S. Case No.90 of 2019 for the offence under Section 307 of the Indian Penal Code and Section 27 of the Arms Act. Learned counsel for the petitioner submits that petitioner has no criminal antecedent. Petitioner is an Ex. Army man working as Guard in the bank. Learned counsel further submits that on account of scuffle, the petitioner has open fired, caused injuries on the thigh of the son of informant. Learned counsel further submits that petitioner is custody since 28.02.2019 and after investigation, police has submitted charge sheet.

Considering the fact that after investigation, police has submitted charge sheet and petitioner has no criminal antecedent, the Court is inclined to grant bail to the petitioner. Let the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya, in connection with Kotwali P.S.
