The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 406, 420 of the Indian Penal Code and 4 and 26(A) of the Bihar Minor Minerals Concession Rules, 1972.

The prosecution case is that the petitioner being a brick kiln owner has not deposited the tax during the financial year 2014-15.

It is submitted by learned counsel for the petitioner that the petitioner has deposited the required tax when the brick kiln was operational but claims that when the brick kiln was not operational the petitioner has not deposited the tax.

Patna High Court Cr.Misc. No.8660 of 2016 (2) dt.23-02-2016 2/2 A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the nature of accusation, let the above named petitioner be released on anticipatory bail provisionally for six months, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Minapur P.S. Case No. 302 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. The provisional bail of the petitioner will be confirmed by the learned court below on deposit of the proof with regard to deposit of required due taxes, if any. (Dinesh Kumar Singh, J) DKS/- U T
