Mr.Mohammad Sufyan, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 10-07-2024 Heard Mr. Santosh Kumar, learned counsel appearing on behalf of the petitioners and Mr. Mohammad Sufyan, learned APP for the State.

2. Petitioners seek pre-arrest bail in connection with Sonbarsa P.S.Case No.59/2017, registered for the offences punishable under Sections 341, 323, 324, 504, 506, 379/34 of the Indian Penal Code but the cognizance has been taken under Sections 341, 323, 325, 307 & 504/34 of the Indian Penal Code.

3. Learned counsel appearing on behalf of the petitioners submits that the petitioners were granted "provisional bail" but due to their inaction to abide by the conditions, their bail bond was cancelled and after investigation,

Patna High Court CR. MISC. No.40471 of 2024(2) dt.10-07-2024 2/2 the Investigating Officer has submitted charge-sheet under the major Sections of the Indian Penal Code.

4. In view of the above facts, learned counsel appearing on behalf of the petitioners seeks to withdraw the present bail application with a liberty to surrender before the district court in connection with Sonbarsa P.S.Case No.59/2017 for grant of regular bail.

5. Considering the aforesaid submissions made on behalf of the petitioners, I find it proper that if the petitioners surrender before the district court and seek regular bail, the district court may consider their prayer for grant of regular bail on the basis of the materials available on record and pass a reasoned order on the same day.

6. With the above observation/direction, the present bail application stands disposed of.
