2. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 342, 323, 504, 363, 366A and 34 of the Indian Penal Code.

As per prosecution case, on 08.02.2023, while the informant along with his daughter Banti Kumari and his fatherin-law was going to his Nanihal and reached near Nahar Par at 12 o'clock, in the meantime all the F.I.R. named accused persons, including these petitioners, surrounded them and started abusing and assaulting them with fists and slaps and
Patna High Court CR. MISC. No.42377 of 2024(2) dt.22-07-2024 2/3 thereafter, they forcibly dragged the minor daughter of the informant and kidnapped her.
4. It is submitted by learned counsel appearing on behalf of the petitioners that Petitioner No. 1 is mother, Petitioner No. 2 is father and Petitioner No. 3 is brother of coaccused Dharamveer Kumar. As a matter of fact, co-accused Dharamveer Kumar and daughter of the informant were in love affair and both of them have married in a temple. It is further submitted that these petitioner have got no role in the alleged occurrence and they have been falsely implicated in this case with ulterior motive only because they happen to be relatives of co-accused Dharamveer Kumar. Petitioners claim clean antecedents.

On the other hand, learned A.P.P. for the State and learned counsel for the informant have vehemently opposed the prayer for grant of anticipatory bail to the petitioners and submitted that these petitioners are named in the F.I.R. and they are involved in the kidnapping of minor daughter of the informant, who is still traceless.
6. Considering the aforesaid facts and circumstances, nature of accusation and the fact that the victim is still traceless,
