1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Barh P.S. Case no. 93 of 2024 registered under section 392 of the Indian Penal Code.

3. As per the prosecution case, the informant states that two accused persons on the motorcycle dashed the motorcycle of the informant and on the point of pistol looted him of Rs. 50,000/ in cash, laptop, ATM Card, mobile phone and other articles as mentioned in the FIR.

4. It is submitted by learned counsel for the petitioner that the FIR was registered against unknown. The petitioner has been falsely implicated in the case in course of investigation when allegedly stolen articles were recovered from the possession of the petitioner. Referring to the seizure list,

No.39630 of 2024(2) dt.04-06-2024 2/2 learned counsel submits that contrary to the observation of the learned trial Court, the recovery of the alleged articles is not from the petitioner but from the road side as mentioned in the seizure list. The petitioner is in custody since 24.3.2024 and undertakes to cooperate in the case.

5. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the allegations against the petitioner in the F.I.R., the contents of the seizure list enclosed with the FIR and the petitioner being in custody since 24.3.2024, the Court directs the petitioner to be enlarged on bail in connection with Barh P.S. Case no. 93 of 2024 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. Barh, District-Patna.
