The petitioners are accused in connection with Marhowrah P.S. Case No. 251 of 2015 registered under Section 302, 201/34 of the Indian Penal Code.
Accusation is that marriage of Asha Devi, sister of the informant, was performed in the year 2004 with the petitioner no.1 Jaipal Rai and due to non fulfillment of the demand of dowry she has been burnt to death and, thereafter, her dead body has been disposed of.
Learned counsel for the petitioners submits that admittedly the deceased had been married with petitioner no.1 and
Patna High Court Cr.Misc. No.55186 of 2015 (3) dt.30-01-2016 petitioner no.2 is father in law of the deceased. It is further submitted that, in fact, in course of cooking, the deceased sustained burn injuries and when she was being taken to hospital she died on the way and her dead body was disposed of in the knowledge of the informant. Further submission is that due to some ulterior motive, the petitioners have falsely been implicated in this case.
Having regard to the facts and the circumstances of the case, the petitioners, above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saran at Chapra in connection with Marhowrah P.S.
