JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-12-2015 Heard learned counsels for the petitioner and the State. The petitioner being husband of the victim is languishing in custody since 5.10.2015 in a case registered for the offences punishable under Sections 323,504 and 498A/34 of the Indian Penal Code.
The basic accusation is of torture.
It is submitted by the learned counsel for the petitioner that the petitioner was granted anticipatory bail on the condition that he will make payment to the informant but the petitioner failed to make payment and accordingly the bail bonds were cancelled.
Considering the fact that the petitioner was granted anticipatory bail on merits and the nature of accusation, let the
Patna High Court Cr.Misc. No.55572 of 2015 (2) dt.08-12-2015 2/2 above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned in connection with Imadpur P.S. Case No. 17 of 2014 to the satisfaction of learned J.M. Ist Class, Bhojpur at Ara.
