====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ------------- 30-01-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Chakia P.S. Case No.206 of 2015 registered under Sections 420, 467, 468, 471, 406/34 and 120-B of the Indian Penal Code besides Sections 3/4/13 of Foreign Exchange Management Act (FEMA), 1999. The accusation is that the informant approached the U.A.E. Exchange and Financial Services Limited Office for passport for which the informant handed over identity card and voter card to Yugesh Mishra, one of the travell's staffs. While passport was handed over to the informant and he moved for Malesiya and returned from there after five days and engaged

Patna High Court Cr.Misc. No.54967 of 2015 (3) dt.30-01-2016 2/3 himself in business but the identity card of the informant was withheld by Yugesh Mishra and on that very basis the Manager of U.A.E. Exchange and Financial Services Limited and other its staffs exchanged 3750 Saudi Reyal of the value of Rs.65932/-. The petitioner is said to be one of the Guards posted in the Exchange Office and involved in the said transaction. Learned counsel appearing on behalf of the petitioner submits that the petitioner is a retired Military Personnel and was recently appointed in the U.A.E. Exchange and Financial Services Limited as a Guard and he has falsely been implicated in this case on mere suspicion.

Further submission is that the petitioner is also accused in one case lodged by his wife under Section 498-A and other allied Sections of the Indian Penal Code and except that the petitioner has no criminal antecedent and is in custody in the present case since 24.09.2015. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, East Champaran, Motihari, in connection with Chakia P.S. Case No.206 of 2015.
