JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 30-01-2023 Learned counsel for the petitioner submitted that this writ petition may be disposed of in light of the order dated 23.04.2016 as contained in Annexure-7 to this writ petition and a direction may be issued to respondent no. 3 to consider the claim of the petitioner for grant of 3rd Modified Assured Career Progression from the due date.

However, counsel for Union of India submits that petitioner has already retired from service and he is not entitled to get 3rd Modified Assured Career Progression. In reply counsel for petitioner submits that

Patna High Court CWJC No.699 of 2018(8) dt.30-01-2023 2/2 petitioner has retired from service after the year 2021 and as such, he is entitled to get the benefit of 3rd Modified Assured Career Progression.

Considering the aforesaid facts and circumstances, this writ petition is disposed of with direction to respondent no. 3 to consider the claim of petitioner and pass a reasoned and speaking order in accordance with law within a period of three months from the date of receipt/production of a copy of this order.
