This criminal revision has been preferred, under Section 397 read with Section 401 of the Code of Criminal Procedure, against the judgment and order dated 05.12.2017, passed by the learned Additional Sessions Judge-1st, Munger in Sessions Trial No.152 of 2017, arising out of Dharahara Police Station Case No.81 of 2016, whereby the learned trial judge has refused to discharge the petitioner under Section 227 of the Code of Criminal Procedure.

Petitioner is mother of co-accused, Gourav Yadav. According to F.I.R., the informant had suspicion that her daughter was murdered by Gourav Yadav along with his father and mother. Almost identical is the evidence of suspicion during investigation of the case. The Police had submitted charge sheet

Patna High Court CR. REV. No.45 of 2018(3) dt.29-04-2019 2/2 against the petitioner.

The law is well settled that even suspicion would be sufficient to ask an accused to face trial. Therefore, in my view, there is no merit in this criminal revision application. Accordingly, it stands dismissed.
