JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named and it appears from perusal of the impugned order that petitioner was remanded in this case from another case on the basis of his confessional statement in which he accepted his guilt in respect of the present case. Petitioner has not been put on Test Identification Parade nor anything has been recovered from his conscious possession. He is in jail custody since 23.01.2014. No doubt, petitioner carries criminal antecedent but in the present case, except so-called confessional statement, there appears to be nothing against him.
Considering the aforesaid facts and circumstances as
Patna High Court Cr.Misc. No.54232 of 2015 (2) dt.03-12-2015 2/2 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Anil Kumar Ram, Judicial Magistrate 1st Class, Patna in connection with Pirbahor P.S. Case No. 335 of 2011.
