In this case, the petitioners are seeking regular bail in connection with Bihta P.S. Case No. 605 of 2020, arising from Special Case No. 4801 of 2020 registered for offence punishable under section 30 (a) of the Bihar Prohibition and Excise Act. It has been alleged that 70 litres of liquor has been recovered from a motor cycle which was being carried by the petitioners who have been arrested there.

Learned counsel for the petitioners submits that the petitioners are in custody since 17.08.2020, having clean antecedent.

No.33949 of 2020(2) dt.29-01-2021 2/2 Looking to the period of custody and petitioners having no criminal history, let the petitioners above named be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of Special Judge, Excise, Patna in connection with Bihta P.S. Case No. 605 of 2020, subject to the condition that one of the bailors of the petitioners shall be their close relative. The petitioners will not induce any witness or tamper with the evidence. The petitioners shall cooperate in the disposal of trial and make themselves available as and when required by the court. If the petitioners are found involved in the similar type of offence in future, the prosecution will have liberty to make prayer for cancellation of their bail before the court below and the court below will take decision in accordance with law. This order has been passed in presence of Mr. Shyam Kumar Singh, learned counsel for the State.
