2. The instant application for anticipatory bail has been filed by the petitioners apprehending their arrest in a case instituted for the offence punishable under Sections 191(2), 110, 115(2), 118, 352, 351(2), 74 of Bharatiya Nyaya Sanhita.
3. The prosecution case, in brief, is that when the informant returned to his residence, he found the petitioners
Patna High Court CR. MISC. No.36825 of 2025(2) dt.20-06-2025 2/3 along with other co-accused persons assembled there, allegedly abusing his wife by calling her a 'witch'. Upon the informant's protest, the petitioners allegedly assaulted him with a dagger, resulting in head injuries to both the informant and his wife. It is further alleged that the accused persons are involved in the sale of illegal drugs.
4. Learned counsel appearing on behalf of the petitioners submits that the petitioners are innocent and have been falsely implicated in the present case. It is further submitted that both parties are neighbors, and due to an existing dispute between them, the present case has been instituted with false and concocted allegations. It is further submitted that, upon perusal of the injury reports of the informant and his wife, the injuries mentioned therein do not corroborate with the manner of assault as alleged in the prosecution version. Moreover, there is no specific or direct allegation against the petitioners. It is also stated in paragraph 3 of the petition that the petitioners have no criminal antecedents.
5. Learned A.P.P. for the State and learned counsel
Patna High Court CR. MISC. No.36825 of 2025(2) dt.20-06-2025 3/3 for the informant vehemently opposed the prayer of bail.
6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioners on bail. The petitioners are directed to surrender in the Court below within a period of four weeks from today and in the event of their arrest or surrender in connection with Laheriasarai P.S. Case no. 414 of 2024, they will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga, subject to the conditions as laid down under section 438(2) of the Cr.P.C.
