JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 11-01-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Kanti P.S. Case No. 417 of 2015 registered under Sections 414 and 413 of the Indian Penal Code.

The accusation is that police on receiving secrete information about sell and purchase of theft vehicle, reached at Amardeep petrol pump, fromwhere, on seeing police vehicle, some peoples started to fleeing away but on chased two persons apprehended, who disclosed their name as Vilash Sahni and Kunal Sahni (petitioner) and confessed that Bolero bearing registration no. WB-34x-4588 stolen from Kolkata.

Learned counsel for the petitioner submits that while

No.54389 of 2015 (3) dt.11-01-2016 Vikash Sahni and petitioner caught hold and confessed about stolen of seized vehicle from Kolkata but it would appear from the case diary that only the confessional statement of Vikash Sahni was recorded by the police and his signature is only on the seizure list. It is further submitted that petitioner has been arrested near the place of occurrence mere on suspicion. It is further submitted that petitioner has no criminal antecedent and is in custody since 09.09.2015.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M.(West), Muzaffarpur, in connection with Kanti P.S. Case No. 417 of 2015. Out of two sureties, one surety must be the close relative of the petitioner.
