JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 19-02-2021 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of regular bail arises out of Nokha P.S. Case No. 71 of 2020 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 427, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act.

According to the case of the prosecution, the occurrence took place in the background of some dispute over demand of some articles in the shop in question between Ajit Kumar and informant, the shopkeeper. Allegedly, the said coaccused had refused to pay for the articles which were given to him by the informant leading to altercation. Thereafter, Ajit Kumar and other persons variously armed allegedly came and started assaulting the informant. It is further alleged that when

No.35293 of 2020(3) dt.19-02-2021 2/2 the informant had put the shutter of the shop down, the miscreants started indiscriminate firing and on intervention of the local people, they started fleeing away. Two of the persons namely Vicky Patel and Suraj Kumar were overpowered by the private persons and were handed over to the police. Learned counsel appearing on behalf of the petitioner has submitted that except for the general allegation that the petitioner had also accompanied the said Ajit Kumar, there is no specific allegation against him. It appears from paragraph 3 of the application that the petitioner has one criminal antecedent. However, considering the nature of accusation against the petitioner and his period of custody since 17.06.2020, this application is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sr. Vivek Kumar Singh, learned Additional Chief Judicial Magistrate, Sasaram in Nokha P.S.
