JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-12-2015 Heard learned counsel for the petitioner as well as Additional Public Prosecutor for the State.

Allegedly, petitioner and one co-accused were caught just after the alleged occurrence by the villagers but the written report of informant does not disclose about recovery of gold chain. However, it appears that in course of investigation, when the further statement of informant was recorded, she stated that the alleged recovery was made from possession of co-accused Dewari Sahni. The petitioner does not have any criminal antecedent and the investigation of the case has already been completed. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hazipur in connection with Mahua P. S. Case No. 449 of 2015.
