The petitioner apprehends his arrest in connection with Kaji Mohammadpur P.S. Case No. 60 of 2019, registered under Sections 406 and 420 of the Indian Penal Code. Allegation against the petitioner made in the F.I.R. is that the informant is the owner of three show-rooms in Patna and petitioner happens to be the manager. During course of enquiry, it transpired that he had defalcated a sum of Rs. 2,41,549/- and ran away.

It is submitted by the learned counsel for the petitioner that petitioner was in the employment of informant and there happens to be some dispute relating to payment of

Patna High Court CR. MISC. No.34383 of 2019(2) dt.27-05-2019 2/2 salary from the side of the petitioner and for the same, informant lodged an FIR. It is further stated that petitioner has no criminal antecedent.

In view of the facts and circumstances stated hereinabove, the petitioner namely, Kunal Kumar, is directed to surrender in the court below within a period of four weeks from today and in case of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1st Muzaffarpur in connection with Kaji Mohammad P.S. Case No. 60 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
