Petitioner is accused in connection with Dharhara P.S. Case No. 117 of 2015 registered under Section 364A/34 of the I.P.C.

The accusation is of kidnapping of Sonu Kumar, minor son of the informant, Devnandan Prasad Bind, for ransom. Further, allegation of informant is also to the effect that this petitioner has also earlier given threatening for killing of his son. Learned counsel appearing on behalf of the petitioner submits that petitioner has falsely been implicated in this case. In course of investigation, the police recovered the victim boy, Sonu Kumar, son of the informant, who specifically stated in his

Patna High Court Cr.Misc. No.56313 of 2015 (2) dt.16-12-2015 2/2 statement under section 164 Cr. P.C. against the co-accused Viyas Yadav, who kidnapped him, but did not disclose the name of this petitioner. It is also submitted that petitioner has no criminal antecedent and is custody since 24.07.2015.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Munger in connection with Dharhara P.S. Case No. 117 of 2015. Out of two sureties, one surety must be parents or close relatives of the petitioner.
