The petitioners, Mema Yadav and Sanjay Dom, are in custody since 03.09.2015 in Railway (Buxar) P.S. Case No. 29 of 2015 under Section 392 of the Indian Penal Code. Learned counsel for the petitioners submitted that although the F.I.R. was registered alleging that these petitioners snatched Rs. 32,000/- from the informant but the investigating office found this allegation to be false and has filed charge-sheet under Section 420 of the Indian Penal Code.

Learned A.P.P. did not dispute this fact.

From perusal of the case diary, it appears that charge-

Considering the facts and circumstances of the case, I direct that the petitioners, above named, be released on bail on furnishing bail bond of Rs. 5,000/- (Five Thousand rupees) each with two sureties each of the like amount to the satisfaction of the learned Railway Magistrate, Bhojpur at Ara in connection with Railway (Buxar) P.S. Case No. 29 of 2015.
