Heard the parties.

The petitioner is languishing in custody for the offence punishable under Sections 323/324/341/342/379/193/120B of the Indian Penal Code, Sections 33 and 36 of the Bihar Prohibition and Excise Act and Section 25(1-b) and 26 of the Arms Act.

Submission is that no liquor, no fire arm or any incriminating article was recovered from the possession of the petitioner. The petitioner was not there at the place of recovery. Petitioner has stated on oath that he has got no criminal antecedent. He is in custody since 26.04.2020. Investigation of the case is already complete.

No.33864 of 2020(2) dt.22-12-2020 2/2 Considering the entire facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Sonepur P.S. Case No. 231 of 2017, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
