The petitioner seeks bail in connection with Bodh Gaya P.S. Case No.350 of 2015 registered under Sections 354(B) and 342 of the Indian Penal Code.
The accusation is that the petitioner being the Accountant-cum-Receptionist of the Hotel Taj Darbar, Bodh Gaya, entered into the room no.119 of the informant in the night and tried to outrage the modesty of the informant. Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that except the informant, no witness has supported the allegation as made by the
Patna High Court Cr.Misc. No.54926 of 2015 (3) dt.30-01-2016 2/2 informant against the petitioner. It is also submitted that the petitioner being the Accountant-cum-Receptionist of the said Hotel asked the informant for some papers for verification on which the informant became annoyed and lodged this false case against the petitioner. Further submission is that the petitioner has no criminal antecedent and is in custody since 01.10.2015. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya, in connection with Bodh Gaya P.S. Case No.350 of 2015.
Out of the two sureties, one must be close relative of the petitioner, who will file an affidavit giving genealogy as to how he/she is related with the petitioner. The bailors will undertake to furnish information to the court about any change in the address of the petitioner. (Rajendra Kumar Mishra, J) P.S.
