The petitioner is languishing in custody for the offence punishable under Sections 302/34 and 120B of the Indian Penal Code.

Mintu Pathak, the brother of the informant had left the house along with co-accused Subodh Rai and thereafter his dead body was found by the road side. The reason of murder of Mintu Pathak is that few days back, the daughter of Mintu Pathak was kidnapped by the F.I.R. named accused persons including this petitioner. However, petitioner is not named in the Nayagaon P.S. Case No. 31 of 2020 registered relating to the occurrence of kidnapping of the daughter of the victim.

The impugned order also reveals that allegation against the petitioner is of conspiracy.

No.33876 of 2020(5) dt.08-02-2021 2/2 Since no direct material is available against the petitioner and investigation of the case is already complete, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Courtbelow where the case is pending in connection with Nayagaon P.S. Case No. 32 of 2020, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
