JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 2 18-03-2016 By way of the present application preferred under Section 482 of the Code of Criminal Procedure, the petitioner seeks modification in the cause title of the order dated 30.01.2016.

It has been contended by the learned counsel for the petitioner that by the aforesaid order dated 30.01.2016, the petitioner has already been granted bail in connection with Morkahi P.S. Case No. 45 of 2014 registered under Section 366A read with 34 of the Indian Penal Code, but due to inadvertent error in typing the name of father of the petitioner, the petitioner has not been released so far. He has contended that inadvertently in the application filed under Section 439 and 440 of the Code of

Patna High Court Cr.Misc. No.10756 of 2016 (2) dt.18-03-2016 2 / 2 Criminal Procedure, the name of father of the petitioner was typed as "Late Mandal" in place of "Lalo Mandal" as a result of which, in the cause title of the order dated 30.01.2016, the father's name was typed as "Late Mandal".

I have heard learned counsel for the petitioner and perused the record. There appears to be substance in the submission made by the learned counsel for the petitioner. In that view of the matter, the father's name of the petitioner in the cause title of the order dated 30.01.2016 be read as "Lalo Mandal" in place of "Late Mandal".
