Heard the parties.

The petitioner is languishing in custody for the offence punishable under Sections 498A/341/323/34 of the Indian Penal Code and Sections 3⁄4 of Dowry Prohibition Act. This is a case under Section 498A of the Indian Penal Code. Petitioner is in custody since last seven months. Petitioner is ready for amicable settlement with the informant who is wife of the petitioner.

Considering the facts aforesaid, let the petitioner, above named, be released on bail provisionally, on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of

Patna High Court CR. MISC. No.33853 of 2020(2) dt.22-12-2020 2/2 the like amount each to the satisfaction of the learned Courtbelow where the case is pending in connection with Araria (Mahila) P.S. Case No. 155 of 2019, with following further conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.

With further condition that the petitioner shall appear before the court below and the court below after notice to the informant shall endeavour for amicable settlement. If the petitioner would be found cooperative, the court below shall confirm the bail bond of the petitioner and if the petitioner would not be cooperative, the court below shall cancel the bail bond of the petitioner.
