The petitioner, namely, Rakesh Singh, is in custody in Begusarai Moffasil P.S. Case No. 213 of 2014 under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act. The allegation, according to the F.I.R. is that this petitioner and co-accused, Rajesh Singh, fired indiscriminately by pistol at the head of Subodh Singh, as a result of which, he died on the spot. The only defence of the petitioner is that because of land dispute, the petitioner has been falsely implicated and, in fact,

Considering the nature of allegation that the petitioner fired indiscriminately at the head of the deceased, as a result of which, he died, I am not inclined to grant bail to the petitioner.
