JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 01-02-2016 Heard learned counsel for the petitioner, learned counsel for the informant and the learned A.P.P. for the State. The petitioner is accused in connection with Rajepur P.S. Case No. 53 of 2012 registered under Sections 363, 366(A) and 120B/34 of the Indian Penal Code.

The accusation is of kidnapping of Rakhi Kumari, minor daughter of informant, by the petitioner and five others named in the F.I.R. with the help of Roushan Kumar and Vijay Kumar.

Learned counsel for the petitioner submits that, in fact, there was love affairs in between the petitioner and Rakhi Kumari, daughter of informant, and she moved from her house with this

No.55076 of 2015 (3) dt.01-02-2016 petitioner according to her sweet will, but later on, due to pressure of her family, she supported the allegation as made in the F.I.R. and gave her statement under Section 164 of the Cr.P.C. It is further submitted that the victim was examined on 11.07.2012 and her age was assessed at that time in between 19 to 20 years, as such, the victim is major but due to ill motive the petitioner and others have falsely been implicated in this case. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Sikrahna at Motihari, in connection with Rajepur P.S. Case No. 53 of 2012. Out of two sureties, one surety must be the close relative of the petitioner.
