JUSTICE HEMANT GUPTA ORAL JUDGMENT Date: 20-09-2016 The challenge in the present writ petition is to an order dated 11.05.2016 passed by learned Special Judge, Vigilance (Trap), Patna, whereby the grievance of the petitioner that he has not been given complete police papers under Section 207 Cr.P.C. remained unsuccessful.
The learned Special Judge has recorded a finding that the relevant documents were delivered to the accused on 13.10.2014. The grievance of the petitioner is that the supplementary charge sheet and the statement of the witnesses in the said charge sheet has not been supplied to him.
The stand of the prosecution is that the documents have

The best course in these circumstances is that the petitioner may inspect the records and take photocopy of the documents which are missing in the police papers given to him, but the proceedings cannot be held up on account of such a trivial issue. In view of the above, I do not find any error in the order passed by learned Special Judge. The writ application is dismissed with liberty to the petitioner to obtain copies of the documents at his cost by inspection of the records. (Hemant Gupta, J.) Mishra/- AFR/NAFR N.A.F.R.
