Heard the learned counsel for the petitioner and the learned A.P.P. for the State. 2.

The petitioner apprehends his arrest in connection with Dumariyaghat P.S. Case No. 196 of 2021, registered for the offences punishable under Section 304(B) of the Indian Penal Code.

It is alleged that the marriage of the daughter of the informant was solemnized with the petitioner on 14.05.2021 as per Hindu rites and customs, however, the informant got information on 06.08.2021 that her daughter has been killed by the accused persons including the petitioner herein.

The learned counsel for the petitioner

Patna High Court CR. MISC. No.37350 of 2023(2) dt.21-07-2023 2/2 has submitted that the petitioner is innocent, he has been falsely implicated in the present case and he is having a clean antecedent.

Per contra, the learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail.

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the parties and taking into account the materials available on record, apart from considering the facts noted in the impugned order dated 24.08.2023, prima facie the complicity of the petitioner, who is the husband of the deceased victim lady is writ large from the records and the doctor has found the cause of death of the deceased victim lady to be asphyxia due to hanging, hence the present case is at least not a case for grant of anticipatory bail, thus the present petition stands dismissed.
