2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 8(c) and 21(a) of the Narcotic Drugs and Psychotropic Substance Act.

3. As per prosecution case, 4.04 grams of brown sugar, a mobile phone and cash of Rs. 3,060/- was recovered from the apprehended co-accused person who disclosed the name of this petitioner as one of his accomplice. Appellant has got one criminal antecedents of similar nature.

4. Considering the facts and circumstances of the case, recovery of contraband substance and fact that petitioner
