JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-02-2016 Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 504, 506, 379, 34 of the Indian Penal Code.

The prosecution case is that the petitioners committed theft of the she buffalo of the informant on 08.09.2015.

It is submitted by learned counsel for the petitioners that petitioner No. 1 is the brother of the informant and petitioner No. 2 is son of petitioner No. 1 and due to the property dispute the accusation has been levelled. For the occurrence of 08.09.2015 the F.I.R was registered on 11.11.2015.

A statement has been made in para 3 of the petition that petitioners have no criminal antecedent.

No.7441 of 2016 (2) dt.19-02-2016 2/2 Considering the delayed lodging of the case and the relationship of the petitioners with the informant, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, Dehri-on-Sone, Rohtas in connection with Sasaram(Tilathu) P.S. Case No. 1266 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
