JUSTICE SANJAY PRIYA ORAL ORDER 13-08-2019 Heard the learned counsel for the petitioner, the informant and the learned A.P.P. for the State. The petitioner seeks bail in Harnaut P.S. Case No. 355/2017, instituted under Sections 302/34 of the Indian Penal Code.

It is alleged in the written report that on the date of occurrence petitioner assaulted his uncle (cousin father-in-law of informant), Mahesh Yadav, with spade on his neck causing him injury. Thereafter other accused persons assaulted on his head and fled away. He was taken to hospital where he died during course of treatment.

Learned counsel for State has submitted that in the post-mortem report doctor has found several injuries on the person of deceased.

No.36664 of 2019(3) dt.13-08-2019 2/2 In the written report, there is specific allegation against this petitioner of assaulting his uncle (cousin father-inlaw of informant). In view of such, this Court is not inclined to grant bail to the petitioner. Accordingly, prayer for bail of petitioner is rejected.

The trial court is directed to expedite the trial and make efforts to conclude the same as early as possible preferably within a period of nine months from the date of receipt of this order.
