JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 22-06-2021 Heard the parties through video conferencing. The petitioner seeks pre-arrest bail in connection with Koilwar P.S. Case No. 395 of 2019, registered under Sections 366A/34 of the Indian Penal Code and 8 of the Protection of Children from Sexual Offences Act, 2012.
The accusation is that the daughter of the informant, Mithilesh Singh Yadav, aged about 16 years moved in the morning of 20.11.2019 to attend the coaching at M.B. Satyam School, then, in the way Raja Kumar with the help of Rupesh Pandey and Vikash Kumar @ Sipahi kidnapped her with bad intention.
Learned counsel for the petitioner submits that the statement of the victim daughter of the informant was recorded on 19.02.2021 in which she has stated that she had left alone and reached at Chapra from where she moved along with Raja
Patna High Court CR. MISC. No.33420 of 2020(4) dt.22-06-2021 2/2 Babu for Delhi. After two days at Delhi both went to Haridwar where both performed marriage in Mansa Devi Temple. Her husband, Raja Babu, is doing job in Honda Company at Delhi. The learned Judicial Magistrate has assessed age of the victim about 20 years. The victim has not disclosed the name of the petitioner in any manner.
Having regard to the facts and circumstances of the case, let the petitioner, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Koilwar P.S. Case No. 395 of 2019 shall be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge, VI, Bhojpur at Ara, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
