The petitioner apprehends her arrest in Fatuha P.S. Case No. 257/2016, registered for the offences punishable under Sections 420 and 290 of the Indian Penal Code and Sections 47, 51, 54 and 57 of the Bihar Excise Amendment Act. Learned counsel for the petitioner submits that the petitioner is the wife of Krishna Prasad. The police raided the house of Radhe Shyam Prasad, Krishna Prasad and Shesh Kumar, all three sons of late Mahipat Gope. On search, 44 litres of country made liquor was recovered. Husband of the petitioner has already been made accused. The petitioner is lady and she has no manner of concern with the country made liquor kept by her husband. Case No. 257/2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
