JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 25-01-2021 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner is in custody in connection with Session Trial No. 50/2019/138/2019 arising out of Jamhor P.S. Case No.79 of 2018 for the offence under Sections 323, 341, 342, 448, 307, 302 and 506/34 and Section 27 of the Arms Act. By order dated 15.10.2019 passed in Cr. Misc. No. 22424 of 2019, the prayer of the petitioner for bail was rejected with a definite direction to the court below to conclude the trial latest by 31.03.2020. I am in January, 2021.
Learned counsel appearing on behalf of the petitioner informs this Court that the trial is still inconclusive. Under the aforesaid circumstances, the court below is
Patna High Court CR. MISC. No.34832 of 2020(2) dt.25-01-2021 2/2 directed to conclude the trial on day-to-day basis by 31st March, 2021. In the event the trial is not concluded within stipulated time as indicated above, the court below is required to release the petitioner on bail on appropriate terms and conditions and submit failure report to this Court why the trial was not concluded despite direction issued by this Court on 15.10.2019 passed in Cr. Misc. No.22424 of 2019 before Registrar (Vigilance) of this Court.
The application stands disposed of.
