The petitioner seeks bail in Sadar P. S. Case No. 82 of 2019 instituted for the offence under Section(s) 302 and 201/34 of the Indian Penal Code.

Learned counsel for petitioner submits that petitioner is not named in the written report.

It is alleged in the written report that brother of informant was killed and his dead body was thrown behind the bamboo orchard at Chandan Nagar, Musahari Tola. The dead body was seen by the police party in presence of informant. The informant has alleged that his brother has been killed in the

Patna High Court CR. MISC. No.35869 of 2019(3) dt.19-07-2019 2/3 house of Ganesh Kamti and other accused persons are also involved in the murder of his brother.

Learned counsel for petitioner submits that petitioner got no concern either with the co-accused Ganesh Kamti or with the deceased. The name of petitioner has transpired during investigation. Learned counsel for petitioner further submits that during investigation dog squad after smelling the cloth of the deceased came to the house of petitioner and stayed there for five minutes and on that basis only the petitioner and her husband Godha Rishi have been arrested in this case. There is no recovery of any incriminating article from possession of this petitioner. Petitioner confessed before the police. Learned counsel further submits that one of the coaccused has already been granted regular bail by this Court by order passed in Cr. Misc. no. 37914 of 2019. Petitioner is in custody since 17.2.2019 having no criminal antecedent.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the CJM Purnea in connection with Sadar P. S. Case No. 82 of 2019 subject to the condition that
