Learned counsel for the appellant is directed to remove the defect(s), as pointed out by the office, within a period of four weeks after restoration of normalcy. The present application has been filed for modification of the order dated 22-02-2021 passed in Cr. Appeal (SJ) No. 1230 of 2020 by which the petitioner was granted anticipatory bail in connection with Amba P.S. Case No. 130 of 2017 pending in the court of learned Additional District & Sessions Judge-Istcum-Special Judge, SC/ST Act, Aurangabad. It is submitted on behalf of the appellant that due to Corona Pandemic, the appellant could not surrender within the
Patna High Court CR. MISC. No.46291 of 2021(2) dt.18-08-2021 2/2 stipulated time. It is further prayed on behalf of the counsel for the appellant that further time may be extended so that the appellant could surrender in the court below. Considering the submissions made on behalf of the learned counsel for the appellant and the grounds mentioned in the modification application, the period of surrender of the appellant in the court below is extended for a further period of eight weeks from the date of receipt/production of a copy of this order. The rest of the conditions shall remain the same as mentioned in the order dated 22-02-2021 passed in Cr. Appeal. No. 1230 of 2020.
The order dated 22-02-2021 passed in Cr. Appeal (SJ) No. 1230 of 2020 is modified to the extent as indicated above. The modification application is, accordingly, disposed of. (Sudhir Singh, J) A.K.V.//- U T
