02. In the present case, the petitioner seeks bail in connection with Kanti P.S. Case No. 593 of 2024 registered for the alleged offences under Sections 316(2), 316(5), 318(4), 338, 336(3), 61(2) of B.N.S. and Sections 63, 103 & 104 of the Copy Right Act.

03. As per prosecution case, police received secret informant about petitioner and other co-accused persons manufacturing spurious lubricant oil in huge quantity and selling the same. A raid was conducted at the identified place but the miscreants fled away. On search of the place, a number

04. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case and he has no concern with the manufacturing of illicit lubricant oil. The petitioner was not apprehended from the spot and nothing incriminating has been recovered from his person or possession. He has been made accused in this case merely on suspicion. The petitioner runs a chicken shop and apprehended merely on suspicion. Learned counsel further submits that true fact is that co-accused persons used to bring burnt lubricant for further use and supply the same to other co-accused persons, but the petitioner has no concern with the manufacturing of duplicate lubricants. The petitioner is having antecedent of one case in which he is on bail. The petitioner is in custody since 13.12.2024 and charge sheet has been submitted.

05. Learned APP opposes the submission made on behalf of the petitioner.

06. Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the period of custody of the petitioner and submission of charge sheet, the petitioner above named is directed to be released on

No.38025 of 2026(2) dt.17-06-2026 3/3 bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. IIIrd (West), Muzaffarpur/concerned Court in connection with Kanti P.S. Case No. 593 of 2024, subject to the conditions mentioned in Section 480(3) of B.N.S.S. and also the following conditions :

(i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below.

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
