The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 324, 308, 504/34 of the Indian Penal Code.

The prosecution case in nutshell is that petitioners along with co-accused persons called the informant at the house of co-accused Birendra Singh and asked the informant to make a compromise in a case of land dispute otherwise face dire consequences and when the informant refused to do so, all the accused persons including the petitioners assaulted the informant, due to which the informant sustained injuries.

No.37362 of 2022(2) dt.30-11-2022 2/2 It is submitted by learned counsel for the petitioners that petitioners are quite innocent and they have falsely been implicated in the present case. It is also submitted that there is no specific allegation against the petitioners and the injury sustained by the informant is simple in nature as opined by the Doctor. There is land dispute between informant and co-accused Birendra Singh and the petitioners have got no concern with that dispute. A statement has been made in para 3 of the petition that petitioners have no criminal antecedent.

In the facts and circumstance of the case, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Saran, Chapra in connection with Chapra Town P.S. Case No. 770 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Sunil Kumar Panwar, J) nirajkrs/- U T
