The petitioners apprehend their arrest in Patepur P.S. case No. 114/2020 registered under Section 363, 366A/34 of the IPC.

The informant alleged that Vikky Kumar, Ashok Rai, petitioner No.1, Meena Devi, petitioner No.2, Vipin Kumar and Vinay Kumar conspired with each other and Vikky Kumar enticed away his minor daughter.

The learned counsel for the petitioners submits that petitioners are the father and the aunt of Vikky Kumar. The informant is not an eye witness of the occurrence. Nobody has seen the petitioners taking away the victim.

No.34090 of 2020(2) dt.16-03-2021 2/2 Taking into consideration the facts aforesaid and the fact that it was Vikky Kumar who is alleged to have enticed away the daughter of informant and petitioners are the father and the aunt of Vikky Kumar, the petitioners, above named, in the event of their arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order are directed to be enlarged on bail on their furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Vaishali at Hajipur in connection with Patepur P.S. case No. 114/2020, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
