2. The petitioners are apprehending their arrest in Madhusudanpur P.S. Case No. 153 of 2024 registered under Sections 80, 238, 3(5) of the BNS, 2023.

3. As per the prosecution case, the informant is the brother of the deceased. He lodged an FIR stating therein that marriage of his sister was solemnized with the co-accused Rupesh Kumar six years prior to the occurrence. On 29.09.2024, at about 11 'o' clock, the informant was informed that his sister consumed poisonous substance. When informant and his family members went to matrimonial house of the deceased, the persons of the vicinity apprised him that petitioners along with others poisoned his sister and murdered her and also performed her last rites.

4. Learned counsel for the petitioners has submitted that the petitioners are in-laws of the deceased having no concern with the day-to-day affairs of the couple. He has further submitted that when informant came to know the real fact, he compromised the case and compromise petition has been annexed as annexure-2. The petitioners are persons of clean antecedent

5. Learned APP for the State, Mr. J.N. Thakur opposed the prayer for anticipatory bail.

6. Petitioners are family members of the co-accused Rupesh Kumar and when the informant came to know the real fact, he has compromised the case.

Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Bhagalpur in connection with Madhusudanpur P.S. Case No. 153 of 2024, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure/ 482(2) of the BNSS, 2023.

8. The petitioners will appear in the court below on each and every date fixed in the case and if, they fail to do so on two consecutive dates unless they are prevented by extremely adverse circumstances, the learned court below shall be at liberty to cancel the bail bonds of the petitioners.
