The petitioner seeks regular bail in registered for the offences punishable under section 302/34 of the Indian Penal Code.

As per the prosecution case, petitioner and coaccused Punam Devi stabbed repeatedly the son of informant causing his death.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case as during investigation one of the co-accused has confessed that in fact he killed the son of the informant and the knife used in the offence has been recovered from the house of said Punam Devi. Petitioner has got clean antecedent as stated in paragraph

Patna High Court CR. MISC. No.46839 of 2021(3) dt.24-03-2022 2/2 3 of the bail petition. Petitioner is in custody since 25.5.2021. Learned counsel for the State and the informant oppose the prayer for bail and submit that there is allegation that petitioner and co-accused Punam Devi stabbed repeatedly the son of informant causing his death which fact has also been supported by the medical evidence.

Considering the nature of accusation and materials available on the records against the petitioner, his prayer for bail is refused.
