2. The petitioner apprehends his arrest in connection with Alinagar P.S. Case No. 24 of 2023 registered for the offence punishable under Sections 147, 148, 149, 323, 324 307, 379, 354 (A) and 504 of the Indian Penal Code.

3. As per prosecution case, the allegation against the petitioner is that he alongwith other co-accused persons abused the father of the informant while he was coming home and one Mahendra Chaupal gave tangi blow on the head of informant's father and the petitioner assaulted the mother of informant with iron rod, tried to outrage her modesty and also snatched ornaments, mobile etc.

Learned counsel for the petitioner submits that there is a case and counter case between the parties and they are of the same tola of the village and entire family members of the petitioner have been implicated in the instant case. The injury of the injured is simple in nature. Petitioner has no criminal antecedent.

5. Learned APP for the State opposed the prayer for anticipatory bail.

6. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount to the satisfaction of the learned SDJM, Benipur, Darbhanga in connection with Alinagar P.S. Case No. 24 of 2023, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
