Heard the parties.

The petitioners are languishing in custody for the offence punishable under Sections 341/323/307/379/504 and 506/34 of the Indian Penal Code.

For land dispute, both the petitioners allegedly caused injury with spade at the head of Manoj Kumar Yadav and Raushan Kumar Yadav. The doctor has found single injury caused by hard and blunt substance and simple in nature on Manoj Kumar Yadav which is inconsistent with the prosecution

Patna High Court CR. MISC. No.33846 of 2020(2) dt.22-12-2020 2/2 allegation and a sharp cut wound and a grievous injury, at the head of Raushan Kumar Yadav. Petitioners are in custody since last six months. Investigation of the case is already complete. Considering the background and the act alleged against the petitioners as well as completion of investigation, let the petitioners, above named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) each with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Kumarkhand P.S. Case No. 01 of 2020, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioners shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.

(c) The petitioners shall not leave the country without permission of the trial Court.
