Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code and 27 of the Arms Act. The prosecution case is that the informant's husband went to the house of Rajendra Rai to do labour work, while returning the petitioner along with other accused persons attacked him and her husband received fire arm injury. Thereafter indiscriminate firing was made and the bullet hit on head of the husband of the informant, as a result he fell down and died.

It is submitted by the learned counsel for the petitioner that accusation is not specific against the petitioner and due to old enmity petitioner has been roped in the present case in the background of Title Suit being pending between the

Patna High Court Cr.Misc. No.8820 of 2016 (2) dt.25-02-2016 parties.

Let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Ram Krishna Nagar P.S. Case No. 231 of 2015, pending in the court of learned Chief Judicial Magistrate, Patna.

With the above observation this application is disposed of.
