====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 30-08-2024 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks regular bail in connection with Ara Nawada P.S. Case No. 570 of 2023 lodged on 08.08.2023 under Sections 307/34 of the Indian Penal Code and Section 27 of the Arms Act.

3. Learned counsel for the petitioner submits that the bail application of the petitioner was earlier rejected vide order dated 17.02.2024 passed in Cr. Misc. No. 7007 of 2024. Counsel submits that the petitioner is not named in the FIR and by virtue of confessional statement of the co-accused, his name has come in this case. Counsel submits that the petitioner is in custody since 11.08.2023, having clean antecedent. Counsel further submits that the charge sheet has already been filed and report

Patna High Court CR. MISC. No.45110 of 2024(3) dt.30-08-2024 2/2 has been called for, from the report, it transpires to this Court that till date, the case is pending for appearance and not even committed before the trial Court.

4. Learned A.P.P. for the State opposes the prayer for bail.

5. In the present facts and circumstances, this Court is not inclined to grant regular bail to the petitioner.

6. Accordingly, the prayer for regular bail of the petitioner is hereby rejected with liberty that he may renew his prayer for bail two months after framing of charge. (Dr. Anshuman, J.) Aman Kumar/- U T
