2. The accused/petitioner is named in the FIR and apprehending his arrest in connection with Marhowrah P.S. Case No.405 of 2022 registered under Sections 467, 468, 471, 420, 414 and 120-B of the Indian Penal Code.

3. As per FIR, the petitioner alleged to purchase the stolen motorcycle.

4. It is submitted by learned counsel appearing for petitioner that the petitioner was not alleged as a member of gang of persons, who actually alleged to involved in committing theft of motorcycle. It is submitted that the seizure list also appears disputed being not supported by the

Patna High Court CR. MISC. No.36687 of 2026(2) dt.16-06-2026 2/2 independent witnesses/family members, rather same appears supported by the police personnel, who are interested person with the outcome of the prosecution. The petitioner claimed clean antecedent.

5. Learned APP while opposing the prayer of bail submitted that the recovery of stolen motorcycle was made from the house of the petitioner in terms of seizure list.

6. In view of aforesaid facts and circumstances, as the recovery of stolen motorcycle appears made from the house of the petitioner as per seizure list, accordingly, the prayer of anticipatory bail of petitioner stands rejected. (Chandra Shekhar Jha, J.) Sanjeet/- U T
