Petitioner is named in the first information report but no one claimed to have seen the actual killing of the deceased and, at best, it is case of last seen.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, Sikerhana at Motihari in Patahi P.S. Case no. 83/2010 subject to condition that one of the sureties must be close relative of the petitioner and holder of the landed property.
