AC to Government Pleader 17 ====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 03-04-2026 Heard Mr. Chandan Kumar, learned counsel appearing on behalf of the petitioner and learned AC to Government Pleader 17 for the State.

2. Learned counsel appearing on behalf of the petitioner submitted that the authorities have failed to pass an order in light of the law laid down by the Apex Court in Jaggo vs. Union of India & Ors. [SLP (C) No. 5580 of 2024] and Vinod Kumar & Ors. vs. Union of India & Ors., reported in (2024) 1 S.C.R. 1230. The petitioner, having worked as an

Patna High Court MJC No.1885 of 2025(6) dt.03-04-2026 2/3 outsourced employee on a temporary basis for nearly three years continuously, was entitled to be considered for regularization. However, the concerned authority has passed the impugned order without considering the applicability of the aforesaid judgments.

3. Learned counsel for the petitioner further submitted that the matter requires reconsideration by the Additional Collector, Muzaffarpur, in light of the law laid down by the Hon'ble Supreme Court.

4. Per contra, learned counsel for the State submitted that if the petitioner is aggrieved by order dated 16.10.2025, as contained in Memo No. 6184 (Annexure - R/2), the petitioner may avail appropriate remedy in accordance with law.

At this stage, learned counsel appearing on behalf of the petitioner further submitted that the Circle Officer, Sakra, is causing obstruction and has allegedly threatened the petitioner for having approached this Court, and is not permitting the petitioner to discharge his duties even when he has been engaged again on a temporary basis.

6. Considering the aforesaid submissions, the petitioner is at liberty to approach the District Magistrate-cumCollector concerned for redressal of his grievance. Upon such

Patna High Court MJC No.1885 of 2025(6) dt.03-04-2026 3/3 approach, the District Magistrate shall look into the matter and take appropriate action in accordance with law and shall also ensure that no authority, including the Circle Officer, Sakra, shall cause any hindrance in discharge of duty by the petitioner.

7. Let a copy of this order be communicated to the District Magistrate-cum-Collector, Muzaffarpur, the Additional Collector, Muzaffarpur, and the Circle Officer, Sakra, for needful.
