According to the prosecution case itself, petitioner borrowed near about Rs 35/- lakhs on different dates from the informant but did not return the aforesaid amount.

Submission on behalf of the petitioner is that petitioner had already returned Rs 29/- lakhs to the informant which is evident from perusal of annexure 2 series but the informant has lodged this false case with an intent to fetch more interest on the aforesaid amount. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi in Sitamarhi P.S.
