JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 16-02-2018 Heard learned counsel for the petitioner and State. Learned counsel appearing on behalf of the petitioner submits that the case of the petitioner is covered by the decision of this Court dated 03.08.2012 passed in C.W.J.C. No. 13203 of 2012, as contained in Annexure-5 to the writ application. The respondent no.6 in para 7 and 8 of the counter affidavit has mentioned that he is not aware of the decision of the Appellate Authority after remand by this Court vide order dated

Patna High Court CWJC No.20454 of 2016 (2) dt.16-02-2018 2/2 03.08.2012 passed in C.W.J.C. No. 13203 of 2012 directing the appellate authority to decide the case in accordance with law. In view of the above, the order dated 09.05.2012 passed by the Appellate Authority is set aside and the present writ application is disposed of with similar direction to the Appellate Authority i.e. to examine the case of the petitioner and pass fresh order.

With the aforesaid, the writ application stands disposed of.
